We may disclose Personal Data that we collect in accordance with the practices described in this Notice and for the purposes set out in the “How We Use Your Personal Data” section above. The categories of parties with whom we may share Personal Data include:

  • Closers (Licensed Real Estate Agents). Where an offer is prepared for a property, we share the property address, the offer terms, and the property owner's name with the licensed real estate agent assigned to deliver that offer. Closers are contractually restricted to using this information solely to deliver the offer and may not use it for unrelated marketing or disclose it further.
  • Professional Advisors. We share Personal Data with our professional advisors for purposes of audits and compliance with our legal obligations.

We share Personal Data with third-party service providers for business purposes including payment processing, fraud detection and prevention, security threat detection, data analytics, and information technology and storage. We do not currently conduct interest-based or cross-context behavioral advertising, and we do not permit third parties to collect Personal Data through our Website for that purpose. If we begin to do so, we will update this Notice and provide the notices and choices required by applicable law before that activity begins.

Universal Opt-Out Preference Signals

Some browsers and browser extensions send a universal opt-out preference signal, such as Global Privacy Control (GPC) or a “Do Not Track” (DNT) signal, indicating that a visitor does not want their personal information sold or shared. As described in the section below, Sohomey does not sell or share Personal Data, so there is no sale or sharing for such a signal to stop. If that ever changes, we will treat a Global Privacy Control signal as a valid request to opt out of the sale or sharing of Personal Data, as required by California law, and we will update this Notice before any such activity begins.online activity and behavior tracked. If a web service operator elects to respond to a particular DNT signal, the web service operator may refrain from collecting certain Personal Data about the browser’s user. Not all browsers offer a DNT option, and there is currently no industry consensus as to what constitutes a DNT signal. For these reasons, many website operators do not proactively respond to DNT signals. For more information about DNT signals, visit http://allaboutdnt.com.

Property Owners Who Receive Offers

You may receive an offer on your home through Sohomey without ever having visited our Website or created an account. This section explains how we handle your information in that situation.

What we collect. We obtain property records and property owner information from third-party data providers and from public sources, including county assessor and recorder records. This may include the property address, parcel identifier, owner name, ownership history, and tax and assessment information. We do not obtain your financial account information, and we do not run credit checks on property owners.

How we use it. We use this information to identify properties matching a buyer's criteria, to prepare an offer for delivery, and to enable you to respond to that offer. Where you respond, we use your response to update the status of the offer and to notify the submitting agent.

Who we share it with. We share the property address, offer terms, and your name with the licensed real estate agent assigned to deliver the offer to you. We also share information with the service providers described above who host and operate our systems.

Your choices. You may ask us not to contact you again about your property, and you may request access to, correction of, or deletion of the information we hold about you. Contact privacy@sohomey.com with “Property Owner Request” in the subject line. You are never required to create an account, engage any agent, or respond in any way in order to decline an offer or to make such a request.

Receiving an offer places you under no obligation. You do not need to respond, and declining costs you nothing.

Security of Personal Data

We implement and maintain reasonable administrative, physical, and technical security safeguards to help protect Personal Data about you from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction.

Sale and Sharing of Personal Data

Sohomey does not sell Personal Data, and does not share Personal Data for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act. We have not sold or shared Personal Data in the preceding twelve months. We do not sell or share the Personal Data of any individual we know to be under 16 years of age.

We do disclose Personal Data to service providers and contractors who process it on our behalf, under written contracts that limit them to performing the services we have engaged them for and prohibit retaining, using, or disclosing the information for any other purpose. A disclosure of that kind is not a sale or a share.

Where an offer is assigned to a licensed real estate agent for delivery, we disclose the property address, the offer terms, and the property owner’s name to that agent solely so the agent can perform the delivery. That agent is contractually prohibited from using the information for any other purpose, from marketing unrelated services to the owner, from selling or sharing it, and from retaining it after the assignment closes, except where their brokerage’s record-keeping obligations or applicable law require otherwise. Sohomey receives no consideration from any party in exchange for that information. Any referral fee Sohomey later receives from an agent is consideration for the referral of a representation opportunity following a closed transaction, and is not consideration for Personal Data.

Retention of Personal Data

We retain the Personal Data we collect as long as it is necessary to fulfill the purpose for which it was collected as outlined in this Notice and to the extent permitted by applicable legal requirements. Where you request the deletion of your Personal Data, we may continue to retain and use your information as permitted or required under applicable laws for legal, tax, or regulatory reasons or legitimate and lawful business purposes.

Your Rights

Depending on where you are located, you may have the following rights (“Data Subject Rights”) related to the processing of your Personal Data:

  • Request access to your Personal Data. A “Data Subject Access Request” enables you to receive a copy of the Personal Data we hold about you and to check that we are lawfully processing it.
  • Request correction of the Personal Data that we hold about you. This enables you to have any incomplete or inaccurate Personal Data we hold about you corrected, although we may need to verify the accuracy of the new data you provide to us.
  • Request erasure / deletion / removal of your Personal Data. This enables you to ask us to delete or remove your Personal Data where we do not have a valid reason to continue to process it. You also have the right to ask us to delete or remove your Personal Data where you have successfully exercised your right to object to processing, where we may have processed your information unlawfully, or where we are required to erase your Personal Data to comply with local law.
  • Object to processing of your Personal Data where we are relying on a legitimate interest (or those of a third party). You may choose to exercise this right if there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts your fundamental rights and freedoms. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Object to sharing of your Personal Data. You may have the right to limit the sharing of Personal Data, particularly for marketing purposes, depending on where you live and the type of Personal Data in question.
  • Request Third Parties. Obtain a list of third parties to whom we have sold your Personal Data.
  • Request Inferences. Obtain any information about inferences we have made based on your Personal Data as well as information on whether we or one of our processors is using your Personal Data or profiling to make decisions that could make significant decisions about you. NOTE: We are not currently engaging in such profiling that would entail us making such significant decisions about you.
  • Request restriction of processing of your Personal Data. This enables you to ask us to suspend the processing of your Personal Data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise, or defend legal claims; (d) you want us to restrict the use of any “sensitive data” (as defined under applicable law); or (e) you have objected to our use of your Personal Data, but we need to verify whether we have overriding legitimate grounds to process it.
  • Data Portability / Request the transfer of your Personal Data to you or directly to another controller. We will (unless there is an exemption) assist you by securely transferring your Personal Data directly to another controller where technically feasible or by providing you with a copy in a structured, commonly used, machine-readable format.
  • Right to Appeal. Depending on where you are a resident, you may have the right to appeal our responses to your Data Subject Rights requests.

To exercise any of these rights, please submit a request by emailing us at privacy@sohomey.com and include “Data Subject Rights Request” in the subject line. In the request, please specify which right you are seeking to exercise and the scope of the request. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your requests to know or delete.

International Transfers of Personal Data

Our Services are not targeted toward individuals outside the United States. Our activities are such that it may be necessary for Personal Data that we collect to be transferred, as permitted by applicable laws, to the United States and other countries where we or our service providers have facilities. When we transfer Personal Data to a country that is not regarded as ensuring an adequate level of protection for Personal Data under the EU GDPR, UK GDPR, or other applicable laws, we will seek to ensure a similar degree of protection is afforded to Personal Data by ensuring that, where possible, we put in place appropriate safeguards (such as standard contractual clauses approved by the European Commission or other relevant authority) or otherwise transfer Personal Data in accordance with applicable laws, such as where the transfer is necessary for the performance of a contract between you and us or between us and a third party in your interest, where the transfer is necessary to establish, exercise or defend legal claims, or where the transfer is made for important reasons of public interest. For more information on specific mechanisms we rely on for transferring Personal Data, please contact us at the details provided in the “Contact Us” section below.

Children’s Data

The Website is intended for general audiences and is not directed at children. We do not knowingly collect Personal Data (as defined by the U.S. Children’s Online Privacy Protection Act or “COPPA”) from children. If you are a parent or guardian and believe we have collected Personal Data in violation of COPPA, please contact us at privacy@sohomey.com and we will remove the Personal Data in accordance with COPPA.
